Note that you are bound to the terms of use and Privacy Policy once you start accessing the Platform either as a visitor or as an approved user.

Please read these Terms carefully.

1. Introduction

1.1 Disability Support Unlimited (DSU) Platform

DSU is an online Platform for both private clients and participants who are self-funded and plan managed Participants under the National Disability Insurance Scheme (NDIS) wanting to access our disability and nursing support services.

It is also for Support Workers, seeking employment in the disability and healthcare sector. Platform

1.2 About Terms of Use

The terms of use consist of terms that govern your usage and access to this Platform (www.dsu.com.au) and engagement with any of our team members.

1.2.1 As a client or support worker, you represent and warrant that you have the authority to be bound by these Terms of use and Privacy Policy. Use of and access to this Platform means you accept and will comply to these Terms and enter a binding agreement with us.

1.2.2 We have the right to monitor your use of the Platform and determine your compliance with these Terms. You must cease usage of platform and its services if you do not agree with these Terms.

1.3 Changes to Terms

DSU has the right to make changes on the Terms of Use. Updated Terms will be published in our Platform and will take effect immediately. It is your choice and responsibility to carefully read and agree to the updated Terms.

1.4 Confidentiality and Privacy Policy

All information collected, used, or disclosed in our Platform is governed by DSU’s Privacy and Confidentiality Policy.

1.4.1 All information gathered through the platform will remain confidential between the support worker and client.

1.4.2 You must not at any time use or disclose confidential information without the prior written approval of DSU unless you are otherwise required by law.

1.4.3 When mandated by law to disclose confidential information you must inform DSU of the obligation to disclose.

1.4.4 Notify DSU immediately for any suspected or actual breach or unauthorised use, copying or disclosure of confidential information.

2. Use of Platform

2.1 User Eligibility

For use and access of DSU Platform, you must:

2.1.1 Be at least 18 years of age or older to be able to warrant that you have the capacity to enter into a legally binding contract.

2.1.2 User (Client) must have the capacity to decide for oneself and be either funded privately, or under NDIS self or plan managed

2.1.3 User (family members, friends, or Account nominees) have the authority to represent or have legal authority to make decisions on behalf of the Client when registering for them. You also agree that you are responsible for determining suitability of Support Services for the Client.

2.1.4 User (Support Worker) must have legal rights to work in Australia and complied with mandatory screening checks.

2.1.5 Agree to comply to these Terms of Use, DSU Policies and Procedures, Code of Conduct, National Disability Insurance Scheme Act 2013 (Cth) (NDIS Act) and any relevant ethical code of behaviour that applies to you as a Client or Support Worker.

2.1.6 Agree that you or anyone in your household has not been convicted and or is not presently under investigation of serious criminal charges involving violence, sexual offence, or any violation of the Relevant Criminal Conduct.

2.1.7 Agree to disclose any information to be true and continue to be honest at all times.

You may still continue to access the Platform but must not register as a User if you do not satisfy the set criteria above.

2.1 User Registration

You are required to register an account to be able to access services for Client and Support Worker. Upon registration,

2.1.1 You warrant and agree that you will be responsible for your use of the Platform.

2.1.2 You warrant that all information you provide is true, accurate, current, and complete during the registration process.

2.1.3 You agree to regularly update any relevant information to keep it accurate.

2.1.4 You are to immediately notify us of any change relating to the NDIS Plan. Such changes include but not limited to suspension, replacement, cancellation or is insufficient funding to pay for bookings.

2.1.5 You agree to follow the Code of Conduct and always adhere to Privacy and Confidentiality Policy.

2.1.6 You are not to organise Support Services and Bookings including the payment of any support fees or other payments outside of the Platform (‘Offline Arrangement’).

2.1.7 You agree to comply to all applicable domestic and international laws, statutes, and regulations regarding use of the Platform.

Non-compliance with these Terms may result in suspension or termination of your account.

2.2 User Confidentiality

You agree that it is your responsibility to maintain sensitive account detail information such as login username and password to remain confidential to anyone but oneself or account nominee if applicable. Disclosing such details to anyone is highly discouraged.

DSU will not be responsible for any liabilities, losses, or damages arising out of the unauthorised use of your username, password and/or account.

2.3 User Verification

Prior to becoming an approved user, you agree to the following terms:

2.3.1 Truthfully and accurately complete mandatory sections on your Profile.

2.3.2 You agree and consent that DSU may use services from a third party to verify information you have provided such as but not limited to: National Police check, NDIS Worker screening check, Motor vehicle records check, Identity, and qualification verification.

2.3.3 You agree that DSU makes no representation and accepts no liability in regard to accuracy and reliability of using any third-party information available to the public during verification process.

2.4 User Content

2.4.1 We may allow you to post, upload or publish content and information such as health information, reviews, your name, image, or other information you may post on your account.

2.4.2 You are held responsible for all activity that occurs while logged in to or while using the account including each item of content you post, email, or make available to the Platform.

2.4.3 You agree that you are solely liable and under no circumstance must not:
a. provide incorrect or misleading information on your profile or in any communications with DSU’s team
b. post any content or material that is abusive, threatening, obscene, defamatory, libellous, or racially, sexually, religiously, or otherwise objectionable and offensive.
c. use the platform for any illegal activities.
d. violate any law, statute, ordinance, or regulation including laws regarding privacy of other users, anti-discrimination, and false advertising
e. attempt to harass, assault or abuse anyone in the Platform
f. use someone else’s account without consent
g. use or post copyrighted material, unless has license to do so.
h. embed any viruses, trojan horses, worms, time bombs, cancelbots or other similar harmful or deleterious programs in the Platform.

Non-compliance to these terms means you accept that DSU is indemnified for any damage, cost and related loss incurred, directly or indirectly from your actions.

2.5 Feedback and Reviews

You consent and grant license for DSU to use, reproduce, publish and adapt your feedback and reviews created on our Platform, google and or on our Facebook page without restriction.

2.6 Termination of Access

DSU has the right at its discretion to take appropriate action such as disable, suspend, or terminate your access account or some areas to the platform if:

2.6.1 You or your user content does not comply with these terms and may later create liability to DSU or harm other clients and support workers.

2.6.2 There is a technical issue or interruptions such as virus in the Platform.

2.6.3 You have breached the terms and conditions of the Platform.

3. Platform Disputes

For any disputes that arise between Clients and Support workers, we encourage parties to manage and resolve it directly. However, it may not always be appropriate to do so. We then encourage you to lodge a feedback or incident using the Platform or call DSU at 0416 026 856 and we will investigate this matter accordingly.

We genuinely listen to your feedback and act in the best interest of our community to keep everyone safe.

4. Insurance

Support workers employed by DSU and has client engagement thru this Platform is covered by our insurance. Non-compliance and breach of Terms will forfeit your coverage from our insurance.

5. Intellectual Property

DSU and or its licensors or authorised third-party owns the intellectual property of content and materials used on this Platform. You acknowledge and agree that recreation, distribution or selling of DSU materials to anyone is prohibited unless written approval is obtained.

The use of Third-party software in connection to this Platform is governed by the relevant third-party and not by DSU Terms of use.

6. Third Party Links and Cookies

You may encounter links to other third-party websites and other contents that belong to them, in which case we do not have control of, hence, not liable for it.

You agree that you are taking the risk when engaging with such third-party websites or installing third party applications.

You acknowledge that when you access and use the Platform, DSU uses cookies to automatically collect and log data and information.

The use and storage of such data is protected by our Privacy and Confidentiality Policy. You therefore agree to these terms by continuing to access the Platform.

7. Disclaimer and Limitations of Liability

7.1 Refund

DSU does not provide any refund of fees in connection with completed service bookings. However, this Terms does not limit your right or obligation that you may have under the Australian Consumer Law (ACL).

7.2 Platform

7.2.1 DSU Platform is made available “as is” and “as available” basis without given express or implied warranties. This Platform is not free from defects and may not be compatible with other applications, hardware, or programs.

7.2.2 Except where prohibited by law, DSU will not be liable to any damages, suits, claims and or controversies that may have or have risen from disclosure or display of your content or acts of omission of a member of DSU without limiting the provision of care services by our support workers.

7.2.3 Access to the Platform is through World wide web either directly or through devices that require service fees to access web-based content.

7.2.4 DSU makes no guarantees that the availability of the Platform is always available.

8. Indemnity

In the event of breach of Terms or violation of any law on this Platform, have been negligent and infringed the rights of any third-party, you acknowledge and agree to indemnify DSU and its representatives from and against any claims, damages, cost or liabilities, including but not limited to personal injury, death, loss of or damage to property, infringement of rights and associated costs.

For any disputes with another user, you agree to release DSU and its members from claims and damages arising out of or in any way connected with such disputes.

9. General

9.1 Communication

Mode of communication will be either thru this Platform, via email at info@dsunlimited.com.au or via phone call at 0416 026 856.

10. Definitions

Account means the profile you have created on this Platform.

Account Nominee means an authorised decision maker on behalf of the client.

Booking means a request Client made to access our support services.

Client means an individual with disability registered thru this Platform

DSU means Disability Support Unlimited, under Entity Name: Fajardo Group Pty Ltd, ACN 656 445 564 | ABN 61 656 445 564

Platform means DSU website www.dsunlimited.com.au

Support Worker means a person or carer that is employed by DSU

User means a person who access or use the Platform
